LIMITED INSTALLATION WARRANTY
These Terms and Conditions (“Agreement”) apply to all proposals, contracts, and services provided by Turfit LLC (“Contractor”) to the Client (“Customer”). By authorizing work or making payment, the Customer agrees to be bound by the following terms:

1. General 5-Year Limited Installation Warranty
1.1 Turfit LLC warrants that its installation work is free from defects in workmanship and materials for a period of five (5) years from the date of project completion.
1.2 To make a claim, the Customer must notify Turfit LLC within the warranty period and in a timely manner.
1.3 This warranty excludes normal wear, damage from accident, misuse, tampering, unreasonable use, natural disasters (including but not limited to hurricanes, tropical storms, and flooding), roots/shoots growing from beneath the project area, reflected heat damage from nearby structures, or modifications for purposes other than the original design intent.
1.4 Warranty does not cover turf installed on driveways between slabs or pavers, turf used for vehicle/trailer parking, or turf damaged by irrigation failure in the base or sub-base.
1.5 Warranty does not include cracking or damage to fire pits as a result of heat or fire damage.

2. Irrigation Policy
2.1 Turfit LLC shall bear no responsibility for the repair or replacement of any irrigation system installed more than one (1) year prior to the commencement of work.
2.2 Prior to work commencement, Turfit LLC will perform an on-site irrigation test. Any pre-existing deficiencies or malfunctions in the irrigation system that affect the project are excluded from all warranties.
2.3 Warranty coverage for irrigation systems applies only to systems installed in full by Turfit LLC.
2.4 Any damage to Turfit LLC’s work resulting from an irrigation system not installed by Turfit LLC is expressly excluded from warranty coverage.
2.5 Turfit LLC is not responsible for repairs to irrigation lines that are improperly installed, more than one (1) year old, or not properly identified/marked before work begins.

3. Kids and Pets Policy
3.1 The Customer is solely responsible for ensuring that all pets, children, and other potential sources of interference or damage remain outside the designated work area at all times.
3.2 Any damage to work in progress caused by a violation of this provision shall be repaired by Turfit LLC at the Customer’s expense, billed at the applicable labor and materials rate.

4. Downspout Policy
4.1 Turfit LLC provides no warranty for damage resulting from roof runoff where gutters and/or downspouts are not installed.
4.2 Turfit LLC’s standard installation practice is to pipe all downspouts beneath hardscaping or landscaped work using a minimum 4″ PVC pipe.
4.3 Any damage caused by a downspout not piped beneath the work area is expressly excluded from warranty coverage.

5. Utilities Policy
5.1 The Customer is solely responsible for locating, marking, and disclosing the position of all existing utilities, including but not limited to water lines, gas lines, electrical lines, and communication cables, prior to the commencement of work.
5.2 Turfit LLC shall not be liable for any damage to utilities resulting from the Customer’s failure to properly locate, mark, or disclose them.
5.3 Where utilities are located within, beneath, or routed through tree stumps, roots, concrete, asphalt, or any other obstruction requiring heavy excavation for removal, Turfit LLC shall not be responsible for any resulting damage to such utilities.

6. Landscape Lighting Warranty
6.1 Turfit LLC provides a one (1) year limited warranty on all landscape lighting products and related components, covering defects in materials and workmanship under normal residential use.
6.2 This warranty does not cover damage resulting from misuse, neglect, improper installation by others, acts of nature, or unauthorized repairs or alterations.

7. Hardscape & Concrete Provisions
7.1 Pavers – Warranty covers settling and movement due to improper base installation or inadequate edge restraint. Excludes chipping from heavy object impact and sand washout unless paver sealing is included (sealed projects warrant sand washout for 1 year). Color and tone variations in natural materials are not covered.
7.2 Concrete – Warranty excludes aesthetic or hairline cracks; covers only structural cracking greater than 1” caused by improper base installation. Excludes damage from heavy object impact.
7.3 Drainage – Turfit LLC is not responsible for unforeseen drainage issues which result in settling of turf or hardscaping installations, or in discoloration or staining of hardscape materials
8. Existing Structures
8.1 Turfit LLC is not responsible for cracks, chips, or movement in poured concrete or masonry block foundations, pool decks, pool walls, or pool copings caused by removal of existing materials or by use of installation equipment.
8.2 Turfit LLC is not responsible for cracks in dwelling foundations before, during, or after the project due to weak foundations or hydrostatic pressure.
8.3 Turfit LLC is not responsible for the repair of siding, stucco, or rotted door sills that butt up to new hardscaping or landscaping installations.

9. Force Majeure
9.1 Environmental or site conditions, including but not limited to poor sub-grade, excessive precipitation, flooding, or other adverse weather conditions, may prevent Turfit LLC from installing stable bases.
9.2 Any additional costs incurred to mitigate such conditions (e.g., sub-grade correction, drainage improvements, dewatering) are the responsibility of the Customer.
9.3 Turfit LLC shall not be liable for delays or damages caused by events beyond its reasonable control, including but not limited to natural disasters, hurricanes, tropical storms, flooding, severe weather, labor strikes, material shortages, or governmental restrictions.

10. Limitations of Liability
10.1 Turfit LLC shall not be liable for delays, damage, or performance issues caused by weather events, acts of nature, vandalism, negligence of others, or conditions beyond its control.
10.2 Any additional work requested outside of the original written agreement shall be subject to a separate charge and may require a signed change order.
10.3 In no event shall Turfit LLC’s total liability exceed the amount paid by the Customer for the specific service giving rise to the claim.
11. Live Plants Warranty
11.1 Live Plants planted by turfit LLC are warranties for 1 year from time of project completion (doesn’t apply to annual flowers or sod)
11.2 Only live plants with a turfit installed irrigation system, or turfit approved existing irrigation less than 1 year-old are covered by turfit live plant warranty.
11.3 Existing plants on property – some plants on project premises may be damaged during installation. Turfit is not responsible for damage to plant that occurs as a result of normal installation procedures.
11.4 Existing sod in acccess points – turfit will do our best to protect existing sod in project area’s access points. We will use protective boards to cover sod in good condition when we must traverse such an area. Turfit LLC is not financially responsible for damage to sod at such locations when protective measures are taken.
12. Project Scheduling Terms
12.1 Project dates are defined in your contract and are set once the initial deposit is paid.
12.2 turfit LLC reserves the right to change the project start date by up to 30 days. Scheduling changes are a result of weather delays, project change-orders, permitting related issues, un-predictable events, etc. We do our best to stick to the schedule we provide, but things inevitably come up.
By proceeding with the project, the Customer acknowledges they have read, understood, and agreed to these Terms and Conditions and Limited Warranty.
